Wine Gift Basket Shipping Limits in 2026: States, Signatures and Fees

10 min readBy Whisky Shortlist Editorial
Last updated:Published:

Wine gift basket shipping limits depend on the store: Wine Country Gift Baskets and Winebasket publish different state lists, both need an adult 21 or older to sign, and neither ships to PO boxes. Here is what each retailer, carrier and regulator says.

What shipping limits apply to wine gift baskets?

Four limits decide whether a wine gift basket can be delivered: the destination state, an adult signature at the door, the type of address and the carrier. The state list is set by each retailer, so it changes with the store: Wine Country Gift Baskets excludes Maine, Rhode Island, South Dakota and Utah, while Winebasket excludes Arizona, Indiana, Kentucky, Michigan, Mississippi, North Dakota, Tennessee and Utah (checked October 2026).

This page is built from the published shipping policies of Wine Country Gift Baskets, Winebasket and GiftTree, the carriers' own rules, and guidance from TTB and Pennsylvania's Liquor Control Board, rather than first-hand use. It is general information, not legal advice, and any of these rules can change.

  • Destination state: each retailer keeps its own list of states it will not ship wine to, and the lists do not match.
  • Adult signature: someone 21 or older must sign, and FedEx also requires government-issued photo ID; if nobody is home, the carrier tries again and then sends the basket back.
  • Address type: post office boxes, APO/FPO military addresses and foreign addresses are ruled out at the stores checked here.
  • Carrier: only licensed shippers can send wine through FedEx, and the Postal Service does not carry it.
  • Extra costs: signature fees, Alaska and Hawaii surcharges, and summer Express rules for chocolate and cheese.

Each retailer publishes a different state list

Read the two lists side by side and the overlap is small. Only Utah appears on both. Kentucky, Mississippi and Tennessee are closed at Winebasket, yet Wine Country Gift Baskets says a named list of wines, from Barrel Hoops to Windwhistle, may ship there. Arizona, Indiana, Michigan and North Dakota sit on Winebasket's restricted list but also on Wine Country Gift Baskets' list of states it can ship wine to, while Maine, Rhode Island and South Dakota run the other way.

Neither list is a statement of the law itself. Winebasket says "the list of restricted states may change from time to time," and Wine Country Gift Baskets puts its exclusions down to "local ordinances". Wine Country Gift Baskets also reserves the right to swap in a food basket of equal or greater value when an emailed order sends wine to a restricted state.

Winebasket's FAQ adds a clause worth reading before you order. Title to the wine passes to the buyer in New Jersey, and the buyer "takes all responsibility for the shipping it from New Jersey to his/her home state." That wording places the compliance question on the buyer, so if your recipient lives in a state you are unsure about, check with that state's alcohol regulator first.

If one store's list blocks your recipient, the other may not. Check Wine Country Gift Baskets for those addresses (See current price) and compare Winebasket's wine baskets for the same ZIP code (See current price). When both say no, our guide to which states can't receive a wine gift basket covers alcohol-free alternatives.

Why only licensed retailers can ship the wine

Mailing a homemade basket with a bottle tucked inside is not a practical option. The US Postal Service says "Beer, wine, and liquor may not be sent through the mail, except in limited circumstances," and FedEx states that "Individuals (consumers) cannot ship alcohol via FedEx." FedEx carries alcohol only for approved, licensed shippers that have entered into its Alcohol Shipping Agreement.

The federal regulator points the same way. Answering someone who wants to send alcohol to a parent in another state, TTB's FAQ says the Postal Service does not ship alcohol, points to private couriers such as FedEx or UPS, and adds that you should "contact the States to and from which you are shipping to find out if either has any laws or regulations prohibiting this practice." Read alongside FedEx's rule for individuals, the practical route for a gift is a licensed retailer that ships on your behalf. Our walkthrough of how to ship a bottle of wine as a gift legally covers that route step by step.

The 21-plus signature rule and failed deliveries

FedEx and all three stores checked here require an adult to sign. FedEx calls its Adult Signature Required service mandatory on US alcohol deliveries, and the recipient "must be at least 21 years of age, present government-issued photo identification, and sign for the shipment." Wine Country Gift Baskets, which ships by UPS, warns that UPS "cannot leave this package without an adult signature."

Missing the driver costs time and, at some stores, money. Winebasket says the FedEx driver makes three delivery attempts on three separate days, then the package waits at the local delivery warehouse for approximately 2-10 days for pickup before it goes back to the store. A return after failed alcohol delivery attempts carries a FedEx fee of $25 for standard, ground or home shipping and $45 for express, deducted from your refund. GiftTree charges a $4.95 alcohol signature fee per package, which it says FedEx and UPS require, and says the driver leaves a door tag when nobody can sign.

Two habits help avoid a returned gift:

  • Ship to a workplace or to a home where someone 21 or older will be in. Winebasket itself suggests a work address when you are not sure anyone will be home.
  • Tell the recipient a signature is needed. FedEx encourages alcohol shippers to offer alternatives such as hold-at-location pickup, so look for that option at checkout.

Address types that are off-limits

Post office boxes are out at both gift-basket stores. Wine Country Gift Baskets is "unable to ship to PO Boxes, APO/FPO addresses, or international destinations," and Winebasket cannot deliver to a post office box, though it does deliver to rural route addresses. Winebasket also does not ship out of the country.

Canada is a partial exception at one store. Wine Country Gift Baskets ships selected baskets to Canada by FedEx from its warehouse in Kelowna, British Columbia, and the buyer must be 19 or older (18 in Quebec, Manitoba and Alberta).

Alaska and Hawaii are reachable but cost more or travel faster. Wine Country Gift Baskets adds $19.95 per item, while Winebasket ships to both states by Express only. Winebasket also warns about hospitals and hotels. It generally does not recommend sending a basket to a hospital patient, and it is not responsible if a patient or hotel guest has left before the basket arrives, so a home or office address is the safer choice.

Timing, weather and the food in the basket

Wine is not the only part of a basket with rules. Winebasket cannot send fruit baskets to California because of fruit restrictions set by the state's Department of Agriculture. From May to October it ships baskets containing chocolate or fresh cheese by Express, at an extra charge, whenever ground transit would take more than two calendar days. GiftTree limits transit time in the warm summer months too, and may require expedited shipping beyond a 2-day transit window from its offices.

Cutoffs and delivery days vary by store:

  • Wine Country Gift Baskets: orders received before 1:00 PM Pacific, Monday to Friday, ship the same day. Standard shipping is guaranteed to arrive within 5 business days after the order ships, and Saturday delivery costs $34.95 per item on top of standard shipping.
  • Winebasket: can ship the same day when the delivery date you pick requires it, if the order arrives before 3pm Eastern, Monday to Friday, outside legal holidays and the weeks before Christmas.
  • Weather: Wine Country Gift Baskets asks you to allow an extra 1 to 2 days when severe weather or other unexpected delays slow the carriers.

One more fee to expect: Winebasket collects an alcohol shipping fee on orders to New Hampshire.

Volume caps exist, but they are sized for collectors

Some states also cap how much wine one person can receive. Pennsylvania's Liquor Control Board says residents "may receive up to 36 cases (up to nine liters per case) per year of wine shipped by a wine producer licensed by the PLCB as a direct wine shipper," that the limit applies per direct wine shipper, and that direct-shipped wine must be for personal use. Shippers must verify the recipient's age before shipping, and the wine carries state and local sales tax plus a $2.50 per gallon wine excise tax.

A gift basket sits far below a cap like that, but the example shows how much depends on the license behind a shipment. Pennsylvania's rule covers wine producers licensed as direct shippers; other states set their own permits and limits. TTB notes that state laws "vary from state to state" and keeps a list of state alcohol regulatory agencies, which is where to check a specific state.

How to check an address before you pay

  1. Find the state on each store's list. Use the table above, then confirm at checkout, since Winebasket says its list can change and both depend on state rules.
  2. Check the address type. Replace a post office box or military address with a street address.
  3. Plan the signature. Ship to an office or a home where someone 21 or older will be in, and tell the recipient.
  4. Match the calendar. Note the cutoff time, any Saturday option and the summer Express rules for chocolate and cheese.
  5. Read the fine print. Winebasket's title clause covers every wine or spirits order there, and its return fees apply when a delivery fails.
  6. Keep a fallback. If wine cannot go, send a basket without alcohol; our Winebasket vs Wine Country Gift Baskets delivery comparison covers timing at both stores.

FAQ

Can I mail a wine gift basket through the Postal Service?

No. USPS says beer, wine and liquor may not be sent through the mail except in limited circumstances, and FedEx does not accept alcohol from individuals. Buy the basket from a licensed retailer, which ships it for you.

Which states can't receive a wine gift basket?

It depends on the store. In October 2026, Wine Country Gift Baskets listed ME, RI, SD and UT as states it cannot ship wine to, while Winebasket listed AZ, IN, KY, MI, MS, ND, TN and UT. Winebasket says its list may change from time to time, so confirm at checkout with the recipient's address.

What happens if nobody is home to sign?

The carrier will not leave the package. At Winebasket, the carrier's driver tries on three separate days, then the package is held for about 2-10 days before it is returned, and Winebasket deducts a $25 or $45 return fee from your refund.

Can a wine basket go to a PO box or a military address?

Not at the stores checked here. Wine Country Gift Baskets rules out PO boxes and APO/FPO addresses, and Winebasket cannot deliver to a post office box.

Is there a limit on how much wine someone can receive?

Some states set one. Pennsylvania lets residents receive up to 36 cases a year from each licensed direct wine shipper, far more than any gift basket holds; other states set their own limits, so check with the recipient's state alcohol regulator.

Wine Country Gift Baskets — Spirits & Gourmet Gift Baskets

When the occasion calls for sending a bottle rather than buying one for the shelf, Wine Country Gift Baskets is the established option — the retail face of Houdini Inc. (Fullerton, CA, since 1984), the largest catalog and online gift-basket operation in the US, BBB A+ accredited. The catalog spans wine, champagne, and gourmet baskets, with a standing free-shipping collection. The honest fine print worth knowing before you order: alcohol shipping is state-regulated — no wine baskets to a handful of states, and roughly a dozen more accept only wines from an approved list, so confirm your recipient's state at checkout. Alcohol gifts require the recipient to be 21+ with an adult signature on delivery.
